Is there a deadline for appealing?
Yes.  Refer to the deadline submission schedule for deadline and meeting dates.

How do I file an appeal?
Appeals must be filed in writing with the Bylaw Services Office or by contacting the Secretary to the Board of Variance at 604.927.5412 or 604.927.5440. See below for contact information. Click here to download a Notice of Appeal form.

Is there a fee for filing?
Yes.  A non-refundable $175.00  application fee or a $325.00 fee (depending on building permit process).

What information is required for an appeal?

  • Property address
  • Legal description of property
  • Zoning of the site
  • Description of the grounds upon which the Appeal is based, including a Letter of Hardship

What drawings are necessary?
Two sets of plans are required. One set of reduces plans on 8½" x 11" paper and one set of plans drawn to scale that includes the following:
1.  Site plan, at a scale 1/8” to 1’ (1:100 in metric), including northpoint and scale showing:
  • dimensions and area of the site
  • street names
  • size and siting (including setbacks) of all existing and proposed buildings or additions, fully dimensioned
2.  Floor plans, at a minimum scale 1/8” to 1’ (1:100 in metric), including northpoint and scale, if applicable showing:
  • all outside dimensions, including balconies and decks
  • uses of all rooms and other floor areas (finished and unfinished)

3. Elevations at the same scales of the floor plans, if applicable

How are appeals processed?
The Secretary to the Board of Variance receives and reviews appeals and checks all information and drawings. The Secretary then schedules each appeal for hearing, notifies the appellants of the hearing, circulates the appeal information to the Development Services Department (Building Division), notifies the adjacent property owners/occupants and prepares the meeting agenda.

What takes place at a Board of Variance hearing?
  • The Secretary reads aloud the appeal and the appellant’s written grounds for appealing.
  • The Chair calls upon the appellant (or representative) to present any further evidence or explanation of the appeal.
  • Other persons may then speak in support of or in opposition to the appeal.
  • After all presentations are made and questioning is concluded, the appellant is given a final opportunity to speak, where upon the Chair calls for the vote.

At any time during these proceedings, the Board may question any person who has presented information.  All proceedings are informal.

6:30 pm on the first Thursday of every month (See schedule to confirm meeting dates)
