Complete Contest Rules

Participation in the Contest constitutes acceptance and agreement to these Rules. 

No purchase necessary.

In order to participate in the “Win a One Month One City Pass” (the “Contest”) operated by the City of Port Coquitlam (the “City”). The Term of the Contest is from 9:00 a.m., Friday, Dec. 6, 2019 to 11:59 p.m., Thursday, Dec. 12, 2019. The Contest is open to anyone age 18 or over. If a winner is under the age of 18, a parent or legal guardian may accept the prize on their behalf

City of Port Coquitlam staff, elected Port Coquitlam officials and family members are not eligible. 

 

How to enter the Win a One Month One City Pass Contest 

Participants in the Contest (“Entrants”) may enter the contest in the following way(s):

“Follow” us at the City of Port Coquitlam on the platform you are entering on: Facebook, Twitter, Instagram

AND

Share our event either in a Tweet with the #PCCCFitness or in a comment on our contest post found on the City’s Facebook and Instagram accounts. 

Maximum number of one entry per person. 

Entries will be deemed to be made by the authorized Facebook, Twitter or Instagram account holder at the time of entry. “Authorized account holder” is deemed as the natural person who is assigned to a Facebook, Twitter or Instagram address. Anyone found to use multiple social media accounts or platforms to enter will be ineligible. No responsibility is assumed by the City for lost, late, misdirected, or incomplete entries or any computer, online telephone or technical malfunctions that may occur in the processing, transmission or receipt of entries. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter or Instagram.

The date of the draw is Friday December 13, 2019. The prize is a One Month One City Pass, valued at $55. The prize is not transferrable and no cash equivalency of a prize will be awarded as an alternative to the prize.

An alternative entry option is available. Individuals who otherwise meet the above criteria may enter the contest by emailing communications@portcoquitlam.ca. Emails must include the Entrant’s name and telephone contact information.  

Chances of winning the contest will depend on the number of entries received.

Selected Entrant’s Obligations

By entering the contest, you are deemed to have read and accepted the contest rules and regulations.

The City will notify the winning Entrant via social media, email or telephone. If the City does not receive a response within seven days, the City will not make a second attempt to contact the selected Entrant. If the selected Entrant fails to contact the City within this time, they will be considered to have forfeited any potential claim to a prize and an alternate Entrant will be selected. 

In order to receive their prize, each contest winner must correctly complete a mathematical skill-testing question, and sign a standard declaration and release form confirming compliance with the contest rules together with a consent for The City of Port Coquitlam to use the winner’s name and likeness online and in print in any other media in connection with the contest and for advertising and promotional purposes without additional compensation.

Contest winners are responsible for picking up the prizes during normal weekday business hours within three (3) working days of contest winner successfully answering the skill-testing question. Non-compliance within this time period may result in disqualification and selection of an alternate winner. Return of any prize notification as undeliverable or failure of the prize winner to successfully answer the skill-testing question within three (3) working days of notification of selection may result in disqualification and selection of an alternate winner. 

If it comes to the attention of the City by any other means that the selected Entrant has not otherwise complied with these Rules, then the City may, at its sole discretion, declare that the selected Entrant has forfeited the prize. The City may then select an alternate Entrant in accordance with these Rules. The City will not have any liability whatsoever to the first selected Entrant in connection with his or her non-compliance with the Rules or failure to sign the above-noted documents. 

Consent To Personal Information Use And Disclosure

Your information is collected for the purposes of the contest in accordance with Section 26 (c) of the Freedom of Information and Protection of Privacy Act, will only be used for the purpose of contacting you should you win the contest, and will not be disclosed to any other third parties unless directed by you. Other Rules

Under no circumstances will the City be liable for any of the following: 

(a) erroneous, damaged, destroyed, lost, late, incomplete, illegible, incorrectly addressed or misdirected entries, regardless of the cause; 

(b) failure for any reason whatsoever of selected Entrant to receive a prize notification; 

(c) computer, online, telephone, communication, or technical malfunctions or errors that may occur, regardless of the cause; or 

(d) damage or loss, including any loss of use, loss of production, loss of profits (anticipated or otherwise), loss of markets, economic loss, special, indirect or consequential loss or damage or punitive damages, whether in contract, tort or under any other theory of law or equity, arising from, connected with, or relating to the Contest, or the submission of entries to the Contest, or participation in the Contest, or the prize, and regardless of the cause or any negligence by the City, or any person or entity for whom they are responsible, and notwithstanding that any of those entities or persons may have been advised of the possibility of such loss or damage being incurred.  

If for any reason the City determines, at its sole discretion, that the Contest is not capable of being conducted as intended by the City, for any reason whatsoever, including tampering, unauthorized intervention, fraud or any other cause that corrupts or interferes with the administration of the Contest, its security, fairness, integrity or proper conduct of the Contest, the City may in its sole discretion disqualify any Entrant responsible for such misconduct and/or withdraw, cancel, terminate, modify, or suspend all or any part of the Contest. Notice of this withdrawal, cancellation, termination, modification or suspension of the Contest will be posted on the City of Port Coquitlam website.

Any dispute between the City and an Entrant, or any other person arising from, connected with, or relating to the Contest, the submission of entries to the Contest, participation in the Contest, the Contest prizes or any related matters (“Disputes”) will be resolved by a contest judge appointed by the City. This judge’s decision concerning any and all aspects of the Contest, including its administration, will be final and binding on all Entrants.

The Contest is subject to all applicable laws and regulations, and is void where prohibited by law. If any provision of these Rules is found by any court of competent jurisdiction to be unenforceable, that provision will be severed, and all other provisions will remain in full force and effect.

The Contest and all related matters are governed solely by the laws of British Columbia, Canada and applicable federal laws of Canada, excluding any rules of private international law or the conflict of laws which would lead to the application of any other laws. Any legal proceedings brought in connection with the Contest will be resolved before the Courts of British Columbia sitting in the City of Vancouver, British Columbia, Canada, and by entering this Contest, Entrants hereby irrevocably submit and attorn to the original and exclusive jurisdiction of the courts of British Columbia in respect of all legal proceedings. Notice of potential legal proceedings regarding the Contest must be given in accordance with all applicable legislation. 

The name of the winning Entrants may be obtained by sending a self-addressed stamped envelope to the “One Month One City Pass” c/o City of  Port Coquitlam, 2580 Shaughnessy Street, Port Coquitlam, BC V3C 2A8 after Dec. 13, 2019.
